The terms on which PPWR Checker provides compliance documentation software and services.

1. Who we are

These terms are between you and PPWR Checker ("we", "us").

2. What the service is

PPWR Checker is software that produces draft compliance documentation for the EU Packaging and Packaging Waste Regulation, Regulation (EU) 2025/40, from information that you supply about your packaging. It includes:

  • a free applicability check;
  • generation of a Declaration of Conformity, technical documentation, compliance checklists and reporting templates.

The service is a working aid for your own compliance process. It does not replace that process.

3. What the service is not

3.1 This is not legal advice. We provide documentation support built on the official text of the Regulation. We are not your lawyer, we are not your consultant of record, and nothing in the service creates a lawyer–client or advisory relationship.

3.2 You remain the declaring party. A declaration of conformity under Article 39 is a self-certified statement by the economic operator placing packaging on the market. That operator is you. We do not sign declarations on your behalf, we are not a party to them, and we do not assume any obligation of yours under the Regulation.

3.3 The official text prevails. Our output is our reading of the Regulation applied to the data you gave us. Where anything we produce, display or state differs from Regulation (EU) 2025/40, its implementing or delegated acts, national implementing measures, or the position taken by a competent authority, the official source governs and our output does not. References and summaries on this site are provided for convenience; you must verify them against the official text before relying on them.

3.4 National requirements are outside our scope. Extended producer responsibility registration, fees, reporting formats and enforcement are set by each Member State and change independently of us. Unless expressly agreed in writing for a specific engagement, our output does not cover national requirements, and we do not monitor them for you.

3.5 We do not guarantee a regulatory outcome. We do not promise that any authority, auditor, certification body, customer or marketplace will accept a document, that your packaging is compliant, or that your documentation is complete for any particular purpose. Those judgements depend on facts and enforcement decisions outside our control.

3.6 The free check is indicative. It identifies which requirements are likely to apply based on three answers. It is a starting point, not an assessment of your packaging, and no reliance should be placed on it.

4. Your responsibilities

4.1 Accuracy of your data. Our output is only as accurate as the information you provide. You are solely responsible for the correctness, completeness and currency of the packaging data, material specifications, supplier information and company details you enter or send us. We do not audit, test or independently verify them.

4.2 Verification before use. Before you sign, issue, submit or otherwise rely on any document produced through the service, you must review it against the official text of the Regulation and, where appropriate, take professional advice. Signing is your decision and your act.

4.3 Open items. Where information is missing, we mark it as an open item rather than filling the gap. Issuing a document with open items unresolved is your decision and at your risk.

4.4 Changes after delivery. Compliance is not a one-off state. Changes to your packaging, materials, suppliers, markets or to the law itself may make a document inaccurate. Keeping your documentation current is your responsibility; we do not undertake to notify you of legal developments unless a subscription expressly includes that.

4.5 Your data rights. You keep all rights in the data you supply and the documents generated from it. You confirm you are entitled to provide that data to us. Our use of it is described in our Privacy Policy.

5. Accounts

You are responsible for your account credentials and for everything done through your account. Tell us promptly at support@ppwrchecker.com if you believe your account has been used without your authorisation.

6. Prices, payment and renewal

6.1 Prices are shown on the pricing page. The price shown at checkout is the total amount payable.

6.2 One-time purchases are payable in advance. Subscriptions renew automatically for successive periods until cancelled; you may cancel at any time with effect from the end of the current period.

7. Revisions and refunds

7.1 For document generation, we will correct, free of charge, any respect in which a delivered document fails to reflect the data you supplied, provided you tell us within 12 months of delivery. This is your exclusive remedy for defects in the output.

7.2 This does not extend to changes in your packaging, your data, your markets, the Regulation or its national implementation after delivery, nor to a document being rejected or challenged by a third party.

7.3 If you are a consumer in the EU, you have a statutory right to withdraw from a purchase within 14 days. Because our documents are digital content delivered immediately, that right is lost once delivery begins, where you asked us to start immediately and acknowledged that you would lose it. In practice: for a one-time purchase we refund you in full within 14 days of payment provided you have not yet generated or downloaded a document; once a document has been generated or downloaded, the purchase is treated as delivered and clause 7.1 is your remedy. Subscription fees already paid for the current period are not refunded on cancellation.

8. Acceptable use

You agree not to use the service to break the law, infringe anyone's rights, gain unauthorised access to our systems, disrupt the service, or resell or present the output as an independent certification, audit or legal opinion.

9. Intellectual property

The software, templates, document structures and site content are ours and remain ours. You receive a non-exclusive right to use the documents generated for your own packaging and business, including sharing them with customers, auditors and authorities.

10. Availability

We aim to keep the service available but do not promise uninterrupted or error-free operation. We may change, suspend or withdraw features, giving reasonable notice for changes that materially reduce what you have paid for.

11. No warranties

11.1 To the fullest extent permitted by law, the service and everything produced through it are provided "as is" and "as available", and we exclude all warranties, conditions and representations not expressly set out in these terms — including any implied warranty of accuracy, completeness, merchantability, fitness for a particular purpose, or that the output satisfies any legal or regulatory requirement.

11.2 Nothing in this section excludes rights that consumers have under mandatory law.

12. Liability

12.1 Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or under mandatory consumer protection law.

12.2 Subject to 12.1, we are not liable for: indirect or consequential loss; loss of profit, revenue, business, goodwill or anticipated savings; loss or corruption of data; or for fines, penalties, customs holds, product recalls, delisting, loss of market access, or any other regulatory, contractual or commercial consequence arising from your packaging, your documentation or your compliance position.

12.3 We are not liable for any loss to the extent it results from inaccurate, incomplete or out-of-date information supplied by you, from your failure to verify a document before use under clause 4.2, or from a change in law or authority practice after delivery.

13. Your indemnity

You will indemnify us against claims, losses and reasonable costs brought by a third party (including any authority) to the extent they arise from your use of the service, from data you supplied, or from a document you signed, issued or submitted. This does not apply to the extent the claim results from our own breach of these terms.

14. Term and termination

You may close your account at any time. We may suspend or terminate access if you materially breach these terms, giving notice and an opportunity to remedy where the breach can be remedied.

15. Disputes

We do not seek to displace the courts or the law that would apply under the ordinary rules. Nothing in these terms affects the mandatory consumer protections available to you in your country of residence, or your right to bring proceedings before the courts that have jurisdiction under those rules.

16. Changes

We may update these terms. The date at the top reflects the last update, and we will notify you of material changes through the service before they take effect.
